By using Collauth you agree to these terms. If you do not, do not use the service.
1. What Collauth is
Collauth authenticates and values collectible items, issues a blockchain certificate recording what was found, and runs a marketplace where members buy, sell and trade the certified items.
Collauth is not a party to any sale. Members contract with each other. We provide the venue, hold the payment and the certificate until the sale completes, and decide disputes under the published policy. We do not own, hold, inspect, or ship the physical items, except where an item is explicitly placed into Collauth custody.
2. Eligibility
You must be at least 18 and legally able to enter contracts. Access is currently by invitation. One account per person. You are responsible for everything done through your account, and must tell us promptly if you believe it has been compromised.
3. Authentication and valuation are opinions
Our assessment of an item's authenticity, condition and value is an informed opinion produced by automated analysis of the photographs you supply, sometimes with human review. It is not a guarantee, a professional grading service, an appraisal for insurance or tax, or financial advice.
Assessments depend entirely on the photographs provided. An item that is misrepresented, substituted, or photographed to conceal a defect may be assessed incorrectly. Do not treat a Collauth certificate as proof that a physical item in someone's hands is genuine — it records what was assessed at a point in time. The verification tool exists so a buyer can check the item they received against the item that was assessed.
Estimated values are not offers to buy, and nothing on Collauth is a recommendation to buy or sell anything as an investment.
4. Certificates
A certificate is a record on the Solana blockchain, with its files stored on IPFS. Both are public and permanent, as described in the privacy policy.
A certificate represents our assessment of an item. It is not title to the item, and holding one does not by itself make you the owner of the physical object. Certificates are not securities, investments, or currency, and we make no representation that any certificate has or will hold value.
We may revoke a certificate if we determine it was issued on the basis of misrepresented or fraudulent material, or duplicates an existing certificate for the same item. Revoked certificates are removed from the marketplace.
5. Listing and selling
By listing an item you confirm you own it, may lawfully sell it, and that it is the item the certificate describes. Its certificate is locked in escrow while the listing is live.
You must dispatch a sold item promptly, to the address given at checkout, and provide tracking where the delivery method calls for it. Prices are set by you.
Prohibited: counterfeit or replica goods described as genuine, stolen goods, anything you may not lawfully sell, listings that misrepresent condition or provenance, and any attempt to move a transaction off Collauth to avoid fees or buyer protection.
6. Buying
A purchase is a contract with the seller. Your payment is held, and the certificate stays in escrow, until the sale is confirmed complete. Cancellation rights, dispute rights, and time limits are set out in cancellations, refunds and disputes and form part of these terms.
7. Fees
Fees are listed in full at fees and charges and form part of these terms. We will give at least 30 days' notice before increasing a fee or introducing a new one.
8. Payments and payouts
Card payments and seller payouts are processed by Stripe, and your use of them is also subject to Stripe's terms. To receive payouts you must complete Stripe's identity verification. We may hold a payout where a sale is disputed, where verification is incomplete, or where we reasonably suspect fraud.
You are responsible for your own tax obligations arising from your activity on Collauth.
9. Disputes we decide
Where we decide a dispute between members under section 6, our decision determines how the payment and certificate we hold are released. It does not resolve any other claim you may have against the other member, and does not prevent you pursuing that claim elsewhere.
10. Suspension
We may suspend or close an account that breaches these terms, that we reasonably believe is being used fraudulently, or where we are required to by law. We will give reasons where we can. Suspension does not release you from obligations already owed on open transactions.
11. Liability
To the extent permitted by law, Collauth is not liable for the acts or omissions of members, for an item's authenticity or condition beyond the assessment we provided, for loss or damage in transit, for the value of any certificate, or for indirect or consequential loss. Where liability cannot lawfully be excluded, it is limited to resupplying the service or the amount of fees you paid us on the transaction concerned, whichever is greater.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
12. Changes
We may change these terms. Material changes will be notified at least 30 days before they take effect. Continuing to use Collauth after that means you accept them.
13. Governing law
These terms are governed by the law of South Australia, and you and we submit to the courts of that place.
